DO I NEED TO FILE AN APPLICATION WITH THE FCC AND IF SO HOW?
All radio station sales must be approved by the Federal Communication Commission in Washington, D.C. You can NOT take control of a Radio Station until the FCC gives
its permission. This process usually takes about 45 to 60 days on average. (If there are NO problems with the application). We DO NOT give any legal advice on this Site, but it has been our experience that it is a good idea to at least talk with an FCC attorney before filing a Transfer Application. We can recommend several attorneys with whom we have worked. We will tell you up front that they are expensive and you will have to determine how much you want to spend.
We can help you with filling out the necessary FCC forms and we do have copies of the forms that you will need. We also can help you on the fees due when you file your application and where to file your application. Most attorneys can give you a list of things you need to do in filing your application. It has long been our experience that both the seller and buyer share the same FCC attorney and share the cost. In a lot of cases a local attorney can assist you. In most cases a local attorney is less expensive in preparing the Formal Sale Contract and Exhibits.
You will also want to talk with your accountant or CPA about your sale or purchase. It is better to talk with them before than after the sale is made. We have filed many transfer applications and know pretty much the procedure, but again we are NOT attorneys and DO NOT give any legal advice. We will tell you what we think you should do to have a smooth transfer and closing. If we are selling your station, there is no charge for our service, except when we have to travel away from our office on your behalf. If you are selling your station for yourself and need our help, we will charge you on an hourly basis at $75.00 per hour. If you have any questions, please feel free to contact us.
